2. Response to Copyright Infringement Notices

Upon receiving a valid DMCA takedown notification, Nerd Ninja will act expeditiously to remove or disable access to the material identified as infringing, as required by applicable law.

Our response procedures may include:

  • Reviewing the notification for compliance with applicable legal requirements.
  • Removing or disabling access to the identified content.
  • Taking reasonable steps to promptly notify the user responsible for submitting the content.

Where a notification is incomplete, we may request additional information consistent with applicable DMCA requirements.

Nerd Ninja reserves the right to remove or disable access to content without prior notice when appropriate under applicable law or our Terms of Service.

3. Counter-Notification and Content Restoration

If your content has been removed or disabled due to a copyright infringement notification and you believe that removal resulted from a mistake or misidentification, you may submit a written DMCA counter-notification to our designated copyright agent.

A valid counter-notification under 17 U.S.C. § 512(g)(3) must include substantially the following:

  1. Your physical or electronic signature.

Upon receiving a valid counter-notification, Nerd Ninja will promptly forward it to the original complaining party and inform that party of the applicable restoration process.

Under the statutory counter-notification process, removed material will generally be restored no fewer than 10 and no more than 14 business days after receipt of the counter-notification, unless our designated agent first receives notice that the complaining party has filed a court action seeking to restrain the alleged infringement.

Counter-notifications may be shared with the original complaining party as required by law.

4. Repeat Infringer Policy

Nerd Ninja respects copyright ownership and maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat copyright infringers.

This policy applies to registered users and other account holders who repeatedly upload, submit, or distribute content that infringes the intellectual property rights of others.
